What is 'out of repair'?

Is the route founderous? Would it bring a horse to its knees? Those were the tests applied to see if a way was out of repair. Things have moved on some, but there are still routes that would literally bring a horse to its knees - along with cyclists and trail riders. Today the criteria lean more towards suitability for those entitled to use the route - learn more.

Although not for the beginner, one can turn to section 56 of the Highways Act 1980. To greatly over simplify the process, one asks the highway authority if they have the responsibility for the repair of the route. If they say 'yes' and they will not repair then an application is made to a court and (it is hoped) the court will direct the highway authority to repair the route.
